1. Acceptance of Terms
By accessing or using EliteCoach, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform. Your continued use of EliteCoach constitutes your acceptance of any updates to these terms. We recommend reviewing this page periodically for changes.
2. Description of Service
EliteCoach provides an online booking and payment platform that connects sports coaches with clients. Coaches can list their services and availability; clients can discover coaches, book sessions, and pay online. EliteCoach acts solely as a platform intermediary and is not a party to any agreement between coaches and clients. We do not employ coaches or endorse any specific coaching services.
3. Coach Responsibilities
Coaches must provide accurate, complete, and up-to-date information about themselves, their qualifications, and the services they offer. Coaches are responsible for honoring confirmed bookings and notifying clients promptly of any cancellations. Coaches must comply with all applicable local, national, and international laws and regulations, including those governing professional certifications and tax obligations. EliteCoach reserves the right to remove coach profiles that contain inaccurate or misleading information.
4. Client Responsibilities
Clients must provide accurate contact information when creating an account or making a booking. Clients are expected to attend scheduled sessions on time and to follow each coach's stated cancellation and rescheduling policy. Repeated no-shows or fraudulent bookings may result in account suspension. Clients are responsible for any fees incurred as a result of late cancellations or missed sessions.
5. Payments & Refunds
All payments on EliteCoach are processed securely via Stripe. By completing a booking, you authorise the applicable charge to your payment method. Refunds are issued at the discretion of the individual coach in accordance with their stated refund policy. EliteCoach may apply platform or processing fees, which will be displayed before checkout. In the event of a dispute, please contact the coach in the first instance; EliteCoach support can assist where resolution is not reached.
6. Cancellation Policy
Each coach sets their own cancellation and rescheduling policy, which is displayed on their booking page prior to payment. Clients may cancel or reschedule sessions in accordance with the relevant coach's policy. EliteCoach is not responsible for enforcing refunds where a client cancels outside the coach's stated policy window. We recommend reading each coach's cancellation terms carefully before booking.
7. Intellectual Property
All content, design, code, trademarks, and other materials on the EliteCoach platform are the property of EliteCoach or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any platform content without prior written permission. Coaches retain ownership of content they upload, but grant EliteCoach a non-exclusive licence to display that content on the platform.
8. Limitation of Liability
EliteCoach provides the platform "as is" and makes no warranties, express or implied, regarding the quality, safety, or suitability of any coaching services listed. We are not liable for any disputes, injuries, losses, or damages arising from the coach-client relationship. To the fullest extent permitted by law, EliteCoach's aggregate liability for any claim arising out of your use of the platform shall not exceed the total fees paid by you to EliteCoach in the three months preceding the claim.
9. Termination
EliteCoach may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or otherwise cause harm to the platform or its users. We will endeavour to provide reasonable notice before termination where possible. Coaches may delete their accounts at any time via the dashboard settings. Upon account deletion, pending bookings will be handled in accordance with the applicable cancellation policy.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the United States. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in the United States. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
